Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Encored (“Encored,” “we,” “us,” or “our”) governing your access to and use of the Encored mobile application, the website at encoredconcerts.app, and related services (collectively, the “Service”).

By creating an account, downloading, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission of a parent or legal guardian who accepts these Terms on your behalf. In the European Economic Area, you must meet the minimum age required in your country to use information society services, or have valid parental consent where applicable.

You may not use the Service if you are barred from doing so under applicable law or if we have previously suspended or terminated your account for violation of these Terms.

2. The Service

Encored provides tools to:

• Discover concerts and live events;
• Search events and artists;
• Save events, log attendance, and manage your concert history;
• Connect with friends, view activity, and compare musical tastes;
• Mark events for which you are selling tickets (as an in-app indicator for friends, not a ticket marketplace);
• Share links to user profiles and taste comparisons on the web.

We may modify, suspend, or discontinue features at any time. We do not guarantee that the Service will be available at all times or error-free.

3. Your account

You must provide accurate information when registering (including a valid email address and a username that meets in-app rules). You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

Authentication may use email and password and/or one-time verification codes sent to your email. Notify us immediately at support@help.encoredconcerts.app if you suspect unauthorized access.

Usernames and profile content must not impersonate others, infringe rights, or violate these Terms.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Harass, bully, threaten, or abuse other users;
• Post or upload content that is defamatory, obscene, hateful, or infringes intellectual property, privacy, or publicity rights;
• Impersonate any person or entity or misrepresent your affiliation;
• Scrape, crawl, or use automated means to access the Service except as allowed by us in writing;
• Reverse engineer, decompile, or attempt to extract source code from the app except where prohibited by law;
• Interfere with or disrupt the Service, servers, or networks;
• Circumvent security, access controls, or rate limits;
• Use the Service to send spam or unsolicited communications;
• Collect or harvest personal information about other users without their consent.

We may investigate violations and cooperate with law enforcement where appropriate.

5. User content

You retain ownership of content you submit (such as profile photos and information associated with saved events). You grant Encored a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your content solely as necessary to operate, improve, and promote the Service (including showing your profile and activity to other users according to your settings and social connections).

You represent that you have all rights needed to submit your content and that it does not violate these Terms or any third-party rights.

6. Social features and visibility

The Service includes social functionality. Information you share may be visible to friends or other users depending on product design and your choices (including private saved events). You are responsible for what you share and whom you connect with. See our Privacy Policy for details on data use and visibility.

7. Event, artist, and ticket information

Event listings, dates, venues, artists, images, and ticket availability are provided in part by third-party data sources (including JamBase) and may be incomplete, inaccurate, or out of date. Encored does not organize events and is not a ticket seller.

Links to ticket offers may take you to third-party websites. Any purchase is solely between you and that seller. We do not guarantee admission, pricing, refunds, or ticket authenticity. Always confirm details with the venue or official seller before relying on information in the app.

Marking an event as “selling tickets” in Encored is a social signal for friends; it does not process payments or guarantee a transaction.

8. Third-party services and links

The Service integrates with or links to third parties (including Supabase, JamBase, Deezer, Apple App Store, Google Play, and ticket sellers). Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services or content.

9. Intellectual property

The Service, including the Encored name, logos, design, software, and documentation, is owned by Encored or its licensors and is protected by intellectual property laws. These Terms do not grant you any right to use our trademarks except as necessary to use the Service in accordance with these Terms.

Event names, artist names, and third-party logos appearing in the Service belong to their respective owners.

10. Feedback

If you send suggestions or feedback, you grant us the right to use it without restriction or compensation to you.

11. Termination

You may stop using the Service at any time. You may delete your account in the app, which is intended to permanently delete your account data as described in the app and in our Privacy Policy.

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you violated these Terms, pose a risk to the Service or other users, or where required by law. Provisions that by nature should survive termination (including disclaimers, limitations of liability, and governing law) will survive.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR FREE OF ERRORS, OR THAT EVENT OR TICKET INFORMATION WILL BE ACCURATE.

Some jurisdictions do not allow exclusion of certain warranties; in those jurisdictions, our disclaimers apply to the fullest extent permitted by law.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Encored AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY EUROS (€50), OR (C) FIFTY US DOLLARS (USD $50) IF YOU PAID IN USD.

Nothing in these Terms limits liability where it cannot be limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud).

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Encored and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms or any third-party rights.

15. App store terms

If you download the app from the Apple App Store or Google Play, you also agree to the applicable store terms. Apple and Google are not parties to these Terms and are not responsible for the Service. Apple has no obligation to provide maintenance or support for the app except as required by applicable law.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If changes are material, we may provide additional notice in the app or by email where required. Continued use after the effective date of changes constitutes acceptance where permitted by law. If you do not agree to updated Terms, you must stop using the Service and may delete your account.

17. Governing law and disputes

These Terms are governed by the laws of France, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer in the European Union, you may also bring proceedings in the courts of your country of residence. You may use the European Commission’s online dispute resolution platform at ec.europa.eu/consumers/odr.

For users who are not consumers, exclusive jurisdiction lies with the competent courts of Paris, France, subject to mandatory provisions of law.

18. General

• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Encored regarding the Service.
• Severability: If any provision is unenforceable, the remaining provisions remain in effect.
• No waiver: Failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment: You may not assign these Terms without our consent. We may assign our rights in connection with a merger or sale.
• Language: These Terms are written in English. Translations, if any, are for convenience; the English version controls to the extent permitted by law.
